What happens at the 341
Meeting?
The 341 section meeting of creditors is a
hearing in which the bankruptcy trustee asks you questions
under oath. You must bring a photo i.d. and social security
card to the meeting, otherwise the trustee will not conduct
the hearing. Generally, the trustee asks the following
questions: What is your name? What is your social security
number? What is your address? You long have you lived in
(your county), (your state)? Have you ever filed for
bankruptcy before, and if so, when? Did you review and sign
your bankruptcy petition and schedules? Is everything
truthful and accurate? Did you list all your assets, and
all your debts? Are there any changes you wish to address?
Did you file your tax returns? Did you/ or will you receive
a refund or did you/will you owe taxes? Do you have any
pending claims against anyone in which you anticipate
receiving any money? Do you own any real estate? If so,
what is the value and when did you purchase the property?
Based on your particular circumstances, the trustee may ask
some additional questions, but the above are standard with
any case filed. Most people worry that the trustee will
grill them and make them justify why they are filing a
