I just got back from court today on a pretty difficult chapter 13 case. Situations are much more dynamic in a chapter 13 as clients' economic situation changes between negative and positive and can affect your Chapter 13 plan. Looking at this and analyzing http://www.bankruptcysupersite.com , I realized that I really need to go in more depth and cover more issues and try to give more guidance when it comes to keeping real estate and other assets in a chapter 13. By Monday July 28th I will be adding another twenty pages or so under the chapter 13 topic section and really dissect the issues that people inquire about in the same no nonsense approach. I appreciate the emails I have received and plan on covering much more ground in the coming weeks on this site. I am also working on bankruptcy alternatives and various strategies I have picked up in boosting the credit score and dealing with creditors. Bankruptcy and Attorney Fees

I get a call about three times a week asking me if can do a payment plan as far as attorney fees are concerned. My answer always tries to clarify this honestly because so many attorneys and large bankruptcy law firms really muddle the waters on this issue. First and foremost there is not one attorney or bankruptcy law firm that will file your bankruptcy petition until they are full paid. This is just a plain and simple fact. Firms that advertise payment plans and for example, ask you to put down $100.00 to start will basically just open a file in their computer system and probably will not even complete your petition until you are fully paid. So yes there are firms that advertise payment plans which isn't false but it is misleading because most potential clients will assume their case will get going.
Another issue I have with this and would like to share it with you is that even if a lawyer did file a bankruptcy without being fully paid he or she would run the risk of becoming an unsecured creditor after discharge and end up losing their fee. The moral of the story is that the payment plan for a bankruptcy attorney does not exist. So when you see one advertised know that it is just go get you through the door.

Today I was going through my bankruptcy files making a to do list to see was needed to wrap up the week. As I was going through the files I got a call from a credit card company on one of my cients that was preparing to file a chapter 7. The bank was informing me that the client was 90 days past due and that he needed to make a minimum payment of $327.00 on a $5500.00 balance. I asked this credit card company (Bank Of America in this case) how much interest he was being charged, I was told 26.75 %!! Now to most of you readers out there a credit card with this kind of interest is not really a shocker. What was shocking is the fact that I informed them that I was an attorney and that we were proceeding to file a chapter 7 bankruptcy within a few weeks.
I informed the creditor that my client was interested in lowering his rate to around 7% percent and that the likelihood of filing a bankruptcy would diminish. The creditor told me there was nothing he could do and asked when I would have a case number of the filing. I have had some success in negotiating lower rates for clients on credit cards and I have seen the above scenario more than 70% of the time. When you are in over your head in credit card debt and you have really tried to negotiate and make your payments but just can't survive the payments, then I whole heartedly will push for bankruptcy rather than debt consolidation, because sometimes you're better of starting fresh. You probably paid the credit card off ten times over with that kind of interest! If the credit card companies don't feel guilty (THEY DON'T!) than neither should you.
