Will bankruptcy stop my
garnishment?
Once the bankruptcy petition is filed
with the court, an automatic stay is put into effect that
prevents creditors from taking any further collection
actions against you. So, the stay stops the garnishment.
Any money taken from your paycheck prior to the filing of
the bankruptcy will not returned as it was taken by a legal
court order. Any money taken after the filing must be
returned by the creditor.
