Statute of Limitations on Credit Card Debt

There is a statute of limitations on debt so if a debt was written off or shows up as charged off on your credit report odds are you don’t have to pay it back, this will depend on the states statue of limitations which I will list below. For example if you have open accounts open for a certain amount of time you might be able to just hang up on the creditor by telling them the statute of limitations has run. Here is a table of the state statute of limitations from state to state. You can check your credit report on how old the debt is and check the table below to see if you are possibly covered to just walk away and hang up the phone on the collectors. The table below is a statute of limitations on credit card debt only for each state. This statute of limitations applies to creditors who have not filed a lawsuit and have not obtained a judgment against you. This is usually the case with smaller debts $1,000.00 or less. So look over your credit report to see if there are judgments against you regarding some of your debts. Judgments will be dealt with in our bankruptcy section.
